무장한 중국어선, 해적행위를 하고있다고 말했지만 어떻게 민간어선을 쏘느냐고 비판..

유엔해양법협약(United Nations Convention on the Law of the Sea) 105조에 다음과 같이 규정되어 있다.

"On the high seas, or in any other place outside the jurisdiction of any State, every State may seize a pirate ship or aircraft, or a ship or aircraft taken by piracy and under the control of pirates, and arrest the persons and seize the property on board. The courts of the State which carried out the seizure may decide upon the penalties to be imposed, and may also determine the action to be taken with regard to the ships, aircraft or property, subject to the rights of third parties acting in good faith."

"모든 국가는 공해 또는 국가 관할권 밖의 어떠한 곳에서라도 해적선, 해적 항공기, 또는 해적 행위에 의해 탈취되어 해적의 지배 하에 있는 선박, 항공기를 나포하고 그 선박과 항공기 내에 있는 사람을 체포하고 재산을 압수할 수 있다. 또한 나포를 행한 국가의 법원은 해당 해적 행위자에 대한 처벌을 결정할 수 있으며, 선의의 목적에서 행동한 제3자의 권리를 존중할 것을 조건으로 그 선박, 항공기 또는 재산에 대하여 취할 조치를 결정할 수 있다."
